These Terms of Service ("Terms") govern your access to and use of the ClariCare AI mobile app, website at claricare.io, and related services (collectively, the "Service"), operated by Atkins Media ("ClariCare,", ClariCare AI", "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use ClariCare AI. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
2. Accounts
An account is required to use ClariCare AI. You agree to provide accurate, current information and to keep it updated. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at support@atkins-media.com of any unauthorized use.
3. Not Medical Advice
ClariCare AI is an informational wellness tool and is not a medical device, medical service, or substitute for professional medical advice, diagnosis, or treatment. AI-generated content is provided for general informational purposes only. Never disregard professional medical advice or delay seeking it because of something you read on ClariCare AI. If you think you may have a medical emergency, call 911 or your local emergency number immediately.
4. Free Analyses and Subscriptions
New accounts include a limited number of free AI symptom analyses. Once your free analyses are used, continued access requires an active paid subscription. Subscriptions auto-renew until canceled. Pricing, billing frequency, and features are shown before purchase.
4.1 Payments and Renewal
Subscriptions purchased through the Apple App Store or Google Play are billed through your platform account in accordance with that platform's terms. Subscriptions purchased through the web are billed through our payment processor. Payment will be charged at confirmation of purchase and again at each renewal unless canceled at least 24 hours before the end of the current period.
4.2 Cancellation
You may cancel anytime from your platform account (App Store / Play Store) or by contacting us. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partially used periods, except where required by law.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful or fraudulent purpose.
- Share your account or resell access to the Service.
- Reverse engineer, scrape, or interfere with the Service.
- Submit false, defamatory, or infringing content.
- Use the Service to make medical decisions for others without their consent.
6. Your Content
You retain ownership of the information you enter into ClariCare AI (such as symptoms and notes). By using the Service, you grant us a limited license to store and process this content solely to provide and improve the Service. We will not sell your health information.
7. Intellectual Property
The Service, including its software, design, text, and branding, is owned by Atkins Media and protected by copyright and other laws. These Terms do not grant you any rights to use our trademarks or branding without our prior written consent.
8. Third-Party Services
ClariCare AI may display information from third-party services (such as map and care-finder data). We are not responsible for the accuracy, availability, or practices of third-party providers. Your use of such services is subject to their own terms.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or uninterrupted, or that AI analyses will be accurate or complete.
10. Limitation of Liability
To the maximum extent permitted by law, ClariCare AI and Atkins Media, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months preceding the claim, or USD $50, whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless ClariCare AI, Atkins Media, LLC, and our officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Service or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may stop using the Service and delete your account at any time. Sections intended to survive termination (including Disclaimers, Limitation of Liability, and Governing Law) will survive.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the United States and the State of Georgia, without regard to conflict of law principles. Any dispute will be resolved in the state or federal courts located in Georgia, unless otherwise required by applicable law.
